Terms of Use

These Terms govern your purchase from shopfloralkingdom.com, operated by Floral Kingdom Inc. ("Floral Kingdom," "we," "us"). You accept these Terms when you check the agreement box at checkout and place your order. Section 17 contains an arbitration agreement and a class action waiver. It affects your legal rights. Please read it. You can opt out of arbitration within 30 days of your first order.


1. Who we are

2. Who can buy, and where we sell

We sell and ship within the United States only. We do not accept international orders and we do not ship to freight forwarders. If you place an order that breaks this rule, we will cancel it and refund you in full.

You must be 18 or older to buy from us, or old enough to enter into a contract where you live. By placing an order you confirm that you are.

3. Our products

Everything we sell is faux. Our flowers are artificial — manufactured, not grown. They are not fresh flowers, they are not preserved or dried real flowers, and they are not alive. Nothing we sell is a living plant, and nothing we sell will grow, bloom, or need water.

Color and appearance. Screens show color differently, and there is natural variation between production batches. The item you get may differ in shade or shape from the photographs. If the difference is more than you expected, you can return it under Section 9 within 30 days. If the item is not the color you ordered at all, that is a wrong item and Section 10 applies. Nothing in this paragraph limits your rights under California law.

Vases are not included unless a listing says otherwise. Product photography may show a vase for display only.

Materials — what our flowers are made of

Our flowers are made from polyurethane. Real-touch florals are made using a polyurethane material, which is what gives the petals the weight and feel of a real flower. Stems have bendable steel cores so they can be shaped.

An earlier version of these Terms described our products as containing latex. That was wrong, and we have corrected it. If latex matters to you for medical reasons, email us at support@shopfloralkingdom.com before you buy and we will confirm the materials for the specific item you are looking at.

If you have a known sensitivity to synthetic materials, please take that into account before you buy, and think about anyone who will live with the flowers or receive them as a gift.

The material for every item is shown on its listing on our Shop page, so you can check before you add anything to your cart. If you are not sure what an item is made of, email support@shopfloralkingdom.com before you buy and we will tell you. We would much rather answer the question than have you find out the hard way.

If you have a reaction, stop handling the product and seek medical advice. Then contact us at support@shopfloralkingdom.com. Section 10 covers your return and refund, and nothing in these Terms limits our responsibility for injury to a person — Section 16 says so plainly.

4. Pricing and pricing errors

All prices are in US dollars. Prices do not include sales tax, which is calculated at checkout from your shipping address.

Sometimes an item is listed at the wrong price. We may cancel your order for a pricing error only if both of these are true:

  • the price you paid was more than 20% below the price we meant to charge, measured against our intended final price for that item at the time, including any sale or promotional discount that was supposed to apply; and
  • we email you within 3 business days of your order, and before the item ships.

If we cancel for this reason we will refund you in full within 5 business days. If we do not cancel within 3 business days, we honor the price you paid. That is the same window we give ourselves to ship your order, so once your order is on its way the price is locked in.

An example, so this is not vague. Suppose an item normally sells for $58.99 and we are running a 20% sale, so our intended price is $47.19. We could only cancel an order for a pricing error if the listed price had fallen below about $37.75. A price of $47.19 is the sale working correctly, not a mistake, and we cannot cancel your order over it.

If an item you ordered is out of stock, that is not a pricing error. Section 5 explains what happens.

5. Orders and acceptance

Your order is an offer to buy. Our order confirmation email confirms we received your order. It is not our acceptance of it.

These Terms, including Section 17, apply from the moment you place your order, whether or not we go on to accept it. The rest of this section explains when we accept.

We accept your order when we ship it. If we do not accept your order, we will email you within 2 business days and refund you in full within 5 business days.

When we can refuse an order. We may refuse or limit an order if we have a reasonable, good faith belief that it involves any of the following:

  • fraud, or a payment method the person is not authorized to use
  • buying to resell
  • misuse of a promotion, including repeated use of a one-per-customer code
  • a pattern of ordering and returning that is not genuine
  • abusive or threatening behavior toward our staff

We will tell you the reason by email and refund you in full. If you think we got it wrong, reply to that email and a person will review it within 5 business days.

We will never refuse an order because of who you are. Not your race, color, religion, national origin, ancestry, sex, gender, sexual orientation, marital status, age, disability, medical condition, citizenship, immigration status, primary language, or source of income. When we refuse an order we will always tell you the reason in writing.

If an item is out of stock. Sometimes our stock count is wrong and we cannot send you something you have already paid for. That is our error, not yours, and we fix it at no cost to you.

If it happens, we email you within 2 business days and give you three choices:

  • Swap it. Pick a different flower or a different color. If what you pick costs less, we refund you the difference. If it costs more, we tell you the difference first and you decide.
  • Refund that item. We refund it in full and ship the rest of your order.
  • Cancel the whole order. We refund you in full and send nothing.

We will never swap an item for you without you choosing it. If we do not hear back from you within 5 business days, we refund the out of stock item in full and ship the rest, so your order sits waiting on us.

You keep whatever your order qualified for when you placed it. If losing the item drops your order below $50, and you are still keeping part of the order, you still get free shipping and you still get the free gift. Your order qualified when you placed it, and our stock error does not take that away from you. Section 11 says the same thing.

We will never hold your money waiting for stock to come back in.

6. Payment

We accept the payment methods shown at checkout. Payment is processed by Stripe. Card details go directly to Stripe and we never receive your full card number.

When we charge you. We charge your payment method when you place your order. If we do not accept your order, or if we cancel it for any reason, we refund you in full within 5 business days.

By submitting payment you confirm you are authorized to use the payment method.

7. Shipping and delivery

  • We ship orders within 3 business days of when you place them.
  • Shipping is a flat $5.99 per order.
  • Shipping is free on orders of $50 or more. See Section 11 for how we measure the $50.
  • Delivery dates shown at checkout are estimates, not promises. They do not include carrier delays.

If we cannot ship within 3 business days. We will email you before that time is up. The email will give you a new shipping date and two choices: wait for the new date, or cancel for a full refund. If you do not reply, we will cancel your order and refund you in full within 5 business days. You never have to do anything to get your money back.

If the delay is because an item is out of stock, Section 5 controls instead, and we do not cancel your whole order just because you did not reply.

Risk of loss. The package is ours until it reaches you. If your tracking says delivered and the package is not there, email support@shopfloralkingdom.com. We will replace the order or refund you, whichever you prefer, and we will handle the carrier claim ourselves. Please tell us within 30 days of the delivery date so we can still file with the carrier. If you tell us later than that we will still try to help.

Addresses. The address you type at checkout is the address we ship to, so please check it before you pay. We save it with your order exactly as you entered it.

How we tell whose mistake it was. We keep the address exactly as you typed it at checkout and the address on the shipping label. Our carrier may reformat an address into standard postal form, turning "Street" into "ST" or adding a ZIP+4. That is formatting, not a change. If the label routed to a different place than the address you typed, the mistake is ours and we fix it at our cost. We are happy to show you both records.

If the address you gave us was wrong. If the package comes back to us, we will reship it for the cost of shipping, or refund you for the items less the shipping we already paid, whichever you prefer. If it was delivered to the address you gave us and you cannot get it back, we cannot replace it for free, but tell us and we will help however we can.

If we or our shipping provider got it wrong, we fix it at our cost. We send a replacement and you pay nothing.

If the address was right and the package still did not arrive, that is not an address problem. Risk of loss above applies, and we replace your order or refund you, whichever you prefer.

8. Canceling an order

You can cancel any time before your order ships. Email support@shopfloralkingdom.com with your order number and the word "Cancel" in the subject line.

We treat your email as received the moment you send it. If you send it before we hand the package to the carrier, the cancellation stands, even if we read your email later. We will confirm within 1 business day and refund you in full within 5 business days.

If your cancellation and our shipment crossed. Sometimes an order goes out before we have read the cancellation. If that happens, email us when the package arrives and we will send you a prepaid return label. Once it is back with us we refund you in full and you pay nothing.

How we decide. We compare when you sent the email against when the carrier took the package. If you sent it first, the return is on us. If the carrier already had it, your cancellation arrived too late and it becomes a standard return under Section 9, where return shipping is your cost. We are happy to show you the carrier scan time.

Please do not use the item if you are returning it as a crossed cancellation. Section 9's condition rules still apply.

9. Returns and refunds

Standard returns. You can return any item within 30 days of delivery for a refund of what you paid for it.

What condition the item needs to be in. Send it back in a condition we can resell. That means the stems are not cut, bent out of shape, glued, dyed, or damaged. Taking the item out of the box, unwrapping it, and fluffing the petals is fine. That is how the product is meant to be handled and it does not affect your return. You do not need the original box. Any box that protects the item in transit is fine.

Return shipping is your cost for a standard return. Section 10 covers items that arrive damaged, defective, or wrong, and we pay return shipping on those.

We do not offer exchanges. If you want a different item, return the original for a refund and place a new order.

We refund to your original payment method within 5 business days of receiving your return.

10. Damaged, defective, or wrong items

If an item arrives damaged, defective, or is not what you ordered, email support@shopfloralkingdom.com within 30 days of delivery with a photo of the item and its packaging.

You choose: a free replacement, or a full refund. Tell us which one you want and that is what you get. Either way you pay nothing, including return shipping. We may ask you to send the item back, and we will send you a prepaid label.

After 30 days. The 30 day window is for our fast, no questions replacement. It does not limit your rights under California law, including the implied warranty of merchantability, which lasts longer. If you find a problem after 30 days, email us anyway.

Repeat claims. If someone files a high number of damage or non-delivery claims that we can show are not genuine, we may ask for more proof before we replace or refund. We will explain in writing what we need and why. We will not cut off your legal rights, and we will not refuse a claim without telling you the reason.

11. Promotions, discounts, and gifts

Promotions change. The one that applies to your order is the one we were running when you placed it. What the current offer is, what any gift is, and what it is worth are shown on the page where we make the offer. This section sets the rules that apply to every promotion we run, whatever the offer happens to be.

How we measure an order total. Wherever we say "orders of $50 or more," we mean your merchandise subtotal before any discount code, before tax, and before shipping. We use that same measure for free shipping and for any gift.

We measure it at the moment you place your order. Nothing that happens afterward moves you back under the line. If we cancel an item, or something turns out to be out of stock, you keep what your order qualified for when you placed it.

Free shipping. Orders of $50 or more get free standard shipping. This always applies, with or without a discount code. It is the one thing a promotion never takes away from you.

One promotion per order. A discount code cannot be combined with a sale price, with another code, or with a free gift.

Discount codes do not apply to sale prices. A code cannot be used on an item that is already reduced from its regular price.

Free gifts. When we are running a free gift offer, the gift comes with orders of $50 or more, while stocks last. The gift is free. You never pay for it as part of your order.

A gift and a discount code are alternatives. If you use a code, you do not get the gift. If you take the gift, you cannot use a code. You may not receive both. Free shipping applies either way.

When a gift runs out, we stop offering it. We take it off our banner, our cart, and our checkout until we have stock again. We will not advertise a gift we cannot send. Free shipping on orders of $50 or more carries on either way.

If a gift runs out after you have already ordered. If you ordered while the gift was available and we run out before your order ships, that is our problem to fix, not yours. We will email you within 2 business days and give you a choice:

  • A different gift. We will name what we can send and its value in that email.
  • 15% off your merchandise subtotal, refunded to your original payment method.
  • Cancel your order for a full refund.

Tell us which you prefer. If we do not hear back from you within 5 business days, we apply the 15% refund and ship your order, so nothing is held up waiting on us. Whichever you choose, you keep your free shipping and we take nothing else off your refund.

Welcome code. Our welcome code is for your first order and is one use per customer.

If you return items and drop below $50. A free gift comes with orders of $50 or more. If you send items back because you changed your mind, and the merchandise you keep is worth less than $50, the order no longer qualifies for the gift. When that happens:

  • Send the gift back with your return. Put it in the same box. It does not have to be unopened, only in resellable condition, the same standard as Section 9.
  • If you keep it, we take its price off your refund. That price is the gift's regular price, which we show you on the page where we offer it, in your cart, and in your order confirmation email. That is the only number we ever use. If we sent you a substitute gift, we use the value we named in the email that offered it.
  • We will never take more off your refund than the refund itself, and we will never charge your card for a gift. If what we owe you back is less than the gift's price, we simply refund you nothing for that return and the gift is yours to keep.
  • Your other option is to keep $50 or more of merchandise. Then nothing changes and the gift stays yours.

This never applies to damaged, defective, or wrong items. If Section 10 covers your return, you keep the gift and we take nothing off your refund, even if the order drops below $50. The same is true if we canceled your order, if an item was out of stock, if we could not ship it on time, or if the return was our mistake. A gift is only clawed back on a change of mind.

Discount codes and returns. If you used a discount code and return part of the order, we refund what you actually paid for the items you send back. We do not take anything extra off your refund.

We never charge you for shipping that was free when you ordered.

Abuse. We reserve the right to limit or refuse promotional offers, and to refuse service, in cases of suspected abuse, including repeated ordering and returning of qualifying orders, or use of multiple email addresses to claim a welcome offer more than once.

12. Communications and marketing

Transactional messages. When you place an order we will email you an order confirmation and a shipping notification. These are part of your purchase and are sent regardless of your marketing preferences.

Marketing email is optional and opt-in. We send marketing email only to people who have chosen to receive it, by subscribing on our site or by ticking the optional marketing box at checkout.

How you get on the list. When you sign up, we send you one email asking you to confirm. You are on our marketing list once you click the link in that email. If you never click it, we do not email you again.

Leaving an optional box unticked is not an opt-out. If you have already subscribed and later place an order without ticking the optional marketing box at checkout, you remain subscribed. We treat an unticked box as the absence of a new opt-in, not as a request to unsubscribe.

How to stop marketing email. Click the unsubscribe link in any marketing email, or email support@shopfloralkingdom.com. We honor opt-outs promptly. Unsubscribing from marketing does not stop transactional messages about an order you have placed.

Text messages. We do not send marketing text messages. If we introduce them, they will require their own separate opt-in. Agreeing to marketing email will never enroll you in text messages.

Our mailing address appears in every marketing email, as the law requires: Floral Kingdom Inc., 900 Balboa Dr, Arcadia, CA 91007.

13. Intellectual property

All content on shopfloralkingdom.com, including text, photography, graphics, and the Floral Kingdom name and logo, is owned by Floral Kingdom Inc. and is protected by intellectual property law. You may not copy, reproduce, or use it commercially without our written permission.

If you send us a photo or a review, you keep ownership of it. You give us permission to use it on our site, in our emails, and in our ads. You can ask us to stop using it at any time by emailing support@shopfloralkingdom.com, and we will remove it going forward.

14. Acceptable use and links to other sites

You agree not to use the site unlawfully, attempt to gain unauthorized access to our systems, scrape or harvest data, interfere with the site's operation, or submit false information.

Links to other sites. Our site may link to sites we do not run. We are not responsible for their content, their products, or how they handle your information. When you are on one of those sites, their terms and their privacy policy apply, not ours.

15. Disclaimers

Our products. We stand behind what we sell. If an item arrives damaged, defective, or is not what you ordered, Section 10 tells you what we do about it. California law also gives you an implied warranty of merchantability on the goods you buy from us. We do not try to disclaim it, shorten it, or limit it.

Our website. We provide the site itself "as is." We do not promise the site will always be available, error free, or free of interruptions.

Product photographs and descriptions. We try to make every photograph and description accurate. If something on our site turns out to be wrong about an item you bought, tell us and Section 10 applies.

Nothing in these Terms limits any right you have under California or federal law that cannot be waived. That includes your rights under the Song-Beverly Consumer Warranty Act and the Consumers Legal Remedies Act.

16. Limitation of liability

What this section does not cover. Nothing in this section applies to:

  • death or injury to a person,
  • fraud or intentional wrongdoing,
  • a violation of law, or
  • any right you have under California or federal law that cannot be waived, including the Consumers Legal Remedies Act and the Song-Beverly Consumer Warranty Act.

For everything else, and to the fullest extent the law allows, Floral Kingdom Inc. is not liable for indirect, incidental, special, or consequential damages, or lost profits, arising from your use of the site or from the products you buy from us.

Also for everything else, our total liability for a claim will not exceed the greater of $100 or the amount you paid for the order the claim is about.

Who this section covers. The limits in this section apply to Floral Kingdom Inc. and to our officers, directors, employees, contractors, agents, and suppliers. They give none of those people or companies more protection than Floral Kingdom Inc. has itself, and every carve-out at the top of this section applies to all of them equally. Nothing here limits anyone's responsibility for death or injury to a person, for fraud or intentional wrongdoing, for a violation of law, or for any right you have that cannot be waived.

17. Dispute resolution, arbitration, and class action waiver

Please read this section carefully. It affects your legal rights. You can opt out.

17.1 Talk to us first. Before starting an arbitration, email support@shopfloralkingdom.com with your name, order number, and what you want. Give us 30 days to work it out. We will do the same before bringing a claim against you. Time limits on your claim stop running while these 30 days pass.

17.2 Agreement to arbitrate. If we cannot work it out, you and Floral Kingdom Inc. agree that any dispute arising out of or relating to these Terms or your purchase will be settled by binding individual arbitration, not in court. Arbitration is run by JAMS under its Consumer Arbitration Minimum Standards and its Streamlined Arbitration Rules, with the Consumer Standards controlling if the two ever conflict. The rules are at jamsadr.com, and we will mail you a paper copy free if you ask.

17.3 Who decides what. An arbitrator decides the dispute itself. A court, not an arbitrator, decides whether this Section 17 is valid or enforceable and whether a claim falls within it.

17.4 Where and how. If you want a hearing in person, it happens in the county where you live, or somewhere else we both agree on. You can also choose a phone hearing, a video hearing, or a decision on documents alone. You will never have to travel to California to arbitrate.

17.5 Who pays. We pay all JAMS filing, administration, and arbitrator fees, except that you pay the first $250 if your claim is over $10,000. If JAMS charges you anything beyond that, we will reimburse it. Each side pays its own lawyer, unless a law that applies to your claim says the losing side pays, in which case that law controls.

17.6 Small claims. Either of us can bring an individual claim in small claims court instead of arbitration, in the court that serves the place where you live.

17.7 Public injunctive relief. Nothing in this section stops you from seeking public injunctive relief. If you bring a claim for public injunctive relief under California law, that claim goes to a California court, not to arbitration, and it may be paused until the arbitration of your other claims is finished. This right cannot be waived, and no other part of this section limits it.

17.8 Class action waiver. You and Floral Kingdom Inc. agree to bring claims only as individuals. Neither of us may bring a class, collective, or consolidated action, and the arbitrator may not combine more than one person's claims. This paragraph does not apply to public injunctive relief, which Section 17.7 covers.

17.9 Coordinated filings. If 25 or more arbitration demands raising similar claims are filed against us by or with the help of the same law firm or coordinated group, JAMS will administer them in staged batches of no more than 50 at a time, with one arbitrator for each batch. Every deadline on a demand that is waiting for its batch is paused while it waits, so nobody loses a claim because of the queue. Either of us may ask JAMS to decide whether a demand belongs in a particular batch. Nothing in this paragraph stops you from opting out of arbitration under Section 17.11, or from bringing your claim in small claims court under Section 17.6.

If coordinated filings reach 100, either of us can move the whole group to court. If 100 or more arbitration demands raising similar claims are filed against us within any 12 month period by or with the help of the same law firm or coordinated group, either you or Floral Kingdom Inc. may choose to have all of those claims decided in court instead of in arbitration. The choice has to be made in writing within 60 days of the hundredth demand being filed, and once made it covers every demand in that group, including ones the same group files afterwards.

Three things follow if that happens. First, the class action waiver in Section 17.8 does not apply to those claims. We are not going to take the benefit of moving to court and also keep a limit that was written for arbitration. Second, every deadline on those claims is paused from the day the choice is made until the case is filed in court, so nobody loses a claim because of the switch. Third, the claims go to the courts named in Section 18.

This runs in both directions. Either side can make the choice and neither side can force the other to stay in arbitration once the threshold is met. It does not affect your right to opt out under Section 17.11, to use small claims court under Section 17.6, or to seek public injunctive relief under Section 17.7.

17.10 Claims this section does not cover. Nothing in this section requires arbitration of a dispute alleging sexual assault or sexual harassment, which you may bring in court.

17.11 Your right to opt out. You can opt out of arbitration. Email support@shopfloralkingdom.com with your name, your order number, and a sentence saying you opt out of arbitration. Send it within 30 days of the date you place your first order. Opting out costs you nothing, does not change anything else in these Terms, and does not affect your ability to buy from us. If we change these Terms later in a way that changes this section, you get a fresh 30 days to opt out from the date we tell you about the change.

17.12 If part of this section fails. If any part of this Section 17 is found unenforceable, the rest of the section stays in effect and a court may sever the part that failed. If Section 17.8 is found unenforceable as to a particular claim, only that claim goes to court. Everything else stays in arbitration.

18. Governing law and where disputes go

These Terms are governed by California law, without regard to its conflict of laws rules. This does not take away any protection the consumer law of your home state gives you that you cannot waive.

For any dispute that is not going to arbitration and is not a small claims case, we both agree to the state or federal courts in Los Angeles County, California, and we both consent to their jurisdiction. Small claims cases go to the court that serves the place where you live, as Section 17.6 says. Claims for public injunctive relief go to a California court, as Section 17.7 says.

19. Changes to these Terms

We may update these Terms. When we do, we change the "Last updated" date at the top, raise the version number, and post the new version here.

The version that governs your order is the version posted at the moment you placed it. We never apply a later version to an order you already placed.

What that means in practice. If we change our return window, our damaged-item policy, our shipping promise, or anything else after you order, you keep the terms you bought under until everything about that order is finished. That covers your return window, your damaged-item window, and any dispute about that order, however long it takes to resolve. A change we make later never shortens a right you already had.

A change never applies to something that has already happened. If a problem has already come up between us, the version in effect when it came up is the version that governs it.

How we tell you about material changes. If we make a material change, including any change to Section 17, we will email you at least 14 days before it takes effect. We send that email to everyone who has placed an order with us, not only to people who signed up for marketing. You do not need to be on our marketing list to be told that these Terms are changing. We send it to the email address on your order. That is a notice about your purchase, not marketing, and it does not put you on our marketing list. You will also get a fresh 30 days to opt out of arbitration under Section 17.11.

If you already opted out of arbitration, you stay opted out. A new version of these Terms never puts you back into arbitration.

Old versions. We keep every version we have ever published. Email support@shopfloralkingdom.com with your order number and we will send you the version that applied to your order.

20. Notices

How we contact you. We send notices to the email address you gave us with your order. A notice counts as given the moment we send it. Please keep your email address current with us and check your spam folder, because this is how we tell you about a delay, a cancellation, a refund, or a change to these Terms.

How you contact us. Send notices to support@shopfloralkingdom.com, or by mail to the address in Section 27. A notice from you counts as given the moment you send it, not the day we read it.

21. Things outside our control

Sometimes things happen that nobody controls: natural disasters, fire, flood, severe weather, war, civil unrest, epidemics, government action, power or internet outages, carrier strikes, and failures by our suppliers or shipping partners.

If one of these stops us from shipping your order on time, we are not in breach of these Terms. We will email you as soon as we know, tell you what is happening, and give you the choice to wait or to cancel for a full refund.

If we cannot ship your order at all, we refund you in full. Nothing in this section ever lets us keep your money without sending you your order.

22. Transferring these Terms

We may transfer these Terms, and our rights and obligations under them, to another company if we sell or reorganize our business. Your rights do not change if we do, and we will tell you by email. You may not transfer these Terms or your rights under them to anyone else without our written permission.

23. If we do not enforce something

If we do not enforce part of these Terms on one occasion, we do not give up the right to enforce it later. If we make an exception for you once, that does not create a rule for the future. For us to give up a right under these Terms, we have to say so in writing.

24. Severability and survival

If any part of these Terms is found unenforceable, that part is narrowed only as far as needed to make it enforceable, or removed if it cannot be narrowed. Everything else stays in full effect.

Sections 9, 10, 11, 13, 15, 16, 17, 18, 19, 20, 22, 23, 24, 25 and 26 continue to apply after your order is complete.

25. The whole agreement
